Statutory Sick Pay Rebate Scheme to end

Of interest to employers will be the details in relation to the close of the Statutory Sick Pay Rebate Scheme, which comes to an end on 17 March 2022. Any covid related absence or isolation by employees after this date will no longer be covered by the employer reclaiming Statutory Sick Pay.

No new claims may be made after 25 March 2022 and no claims may be amended after that date.

The current scheme, in which employers can claim up to two weeks SSP, allows employers to claim provided that they have a PAYE payroll scheme that began prior to 30 November 2021 and have fewer than 250 employees. Once claim per employee can be made up to a maximum of two weeks, and up to the number of employees on PAYE at 30 November 2021, and you can only claim for employees who were off work on or after 21 December 2021 if they had Covid-19, had Covid-19 symptoms or were self-isolating because someone they lived with had symptoms.

After 25 March 2022 the pre-pandemic rules apply where employers revert to paying SSP once there has been a fourth qualifying day of absence.

Employers are also reminded that SSP increases by £3 to £99.35 from 1 April 2022 (alongside other wage increases, all of which we detailed here.)

I’ve personally worked with Ortolan Legal’s managing director on a number of transactions. Their legal advice doesn’t come wrapped in multiple caveats; it takes account of the commercial realities businesses face. Technically, they are really capable and they’re also highly personable people to work with. They represent real value for money.
