Acas Early Conciliation Window to increase

The Employment Tribunals (Early Conciliation: Exemptions and Rules of Procedure) (Amendment) Regulations 2025 will come into force on 1 December 2025. Published by the Government on 5 November, the regulations double the current ACAS early conciliation window from six to twelve weeks.

The Government states that the aim of this amendment is in an endeavour to assist ACAS - who are so stretched that in some instances they are unable to contact parties at all in the current six week window - it will also allow parties greater scope to resolve workplace disputes before they reach the Employment Tribunal.

When combined with the upcoming Employment Rights Bill proposal to extend the initial time limit for bringing a claim from three to six months, as the ACAS early conciliation window could effectively pause a potential claim for three months first, this could mean a delay of up to nine months before a claim is started at an Employment Tribunal.
