Employers thinking about return to work post COVID

Is the job considered “essential”.  If yes, then staff are expected at work.  Boris recently has extended the sectors he is pushing to get back to work.  If not, then, the next question is can staff continue to work at home?  If yes, then they should do this.  If not, consider furlough/ redundancies.

We expect the Government will shortly be listing more sectors who should look to encourage staff to come back in.  There are then a number of questions the employer needs to consider before allowing staff to return.

The 5 step process

1.     Employers should carry out a COVID-19 Risk Assessment and share the results with the people who work in the organisation;

2.     Consider having cleaning, handwashing and hygiene procedures in line with government/NHS guidance;

3.     Take all reasonable steps to help people work from home;

4.     Take all reasonable steps to maintain a 2m distance in the workplace;

5.     Where people cannot be 2m apart, you have done everything practical to manage the transmission risk.

I have worked with Ortolan Legal since 2010 and used their services extensively. They have provided corporate and commercial legal advice and we have also drawn on their capability in the areas of employment law, dispute resolution and property law. What makes them so different is their ability consistently to deliver commercially focussed and high quality advice at a price point which simply cannot be matched by other law firms. They aim to strip out unnecessary overhead costs, concentrate on the quality of their core service and pass on these cost savings to their clients. It works.
