Fees for those bringing Employment Tribunal claims have been ruled unlawful.

The Government has been forced into a humiliating overhaul of employment tribunal fees after the Supreme Court ruled that the Government was acting unlawfully and unconstitutionally when it introduced the employment tribunal fee.  The Supreme Court added that fees by their very nature were inconsistent with access to justice.

The highest UK court came down in favour of the trade union Unison, which argued that fees of up to £1,200 were preventing workers, especially those on lower incomes, from getting justice. 

We await more details about how the Tribunal system will administer refunds, but this is likely to be a relatively painless process.  We now expect the number of Tribunal claims to dramatically increase in the coming months as the financial barrier has been immediately abolished.
