Right to work checks - updated guidance

Employers will be aware that for every individual employed in the UK (regardless of nationality) must have had a right to work check completed before they start work - and employers must also undertake to carry out repeat checks where required.

Due to Covid-19 there were temporary provisions in place so that manual right to work checks could be carried out remotely. This was due to come to an end on 31 August 2021 but the adjusted right to work checks are now in place until 5 April 2022.

The adjusted provisions include that:
Manual checks can be carried out via video call

Employees can provide scanned documents or photographs which can be sent using email rather than sending original documents

Employers should use the Employer Checking Service where acceptable documents cannot be provided
