Updates to the CPR

As of the 06 April 2020, an amendment was introduced to the Practice Direction to Rule 22 altering the wording of a Statement of Truth.    A Statement of Truth should only be signed where the signatory believes that the contents of the document are true to the best of their knowledge and belief.  Signing a Statement of Truth in circumstances where that belief is not held true may lead to proceedings for Contempt of Court.  To remind signatories of that, all Statements of Truth must now include the following wording:-

"I understand that proceedings for contempt of court may be brought against anyone who makes, or causes to be made, a false statement in a document verified by a statement of truth without an honest belief in its truth."
In addition, the Practice Direction to Rule 32, which governs the preparation of Witness Statements, has been changed to require some information explaining how the statement was taken.  Given the current climate it is expected that a number of statements may be taken remotely via telephone or video conference and as such this mandatory obligation appears to be a well-timed amendment.
