Workplace Drug Testing - on the rise

A number of employment screening companies have reported a rise in annual workplace drug tests in the last few years.

Employers cannot require staff to submit to drug testing without their consent, but provision can be included in contracts for withholding consent to be treated as a misconduct offence.

Employers can also make job offers subject to satisfactory medicals and are using this as an opportunity to gather evidence about historic and current drug use without exposing themselves to claims.
